1.1A bill for an act
1.2relating to game and fish; allowing a nonresident to take fish by spearing from a
1.3dark house;amending Minnesota Statutes 2008, sections 97A.475, subdivision
1.47; 97C.371, by adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2008, section 97A.475, subdivision 7, is amended to
1.7read:
1.8    Subd. 7. Nonresident fishing. (a) Fees for the following licenses, to be issued
1.9to nonresidents, are:
1.10    (1) to take fish by angling, $37.50;
1.11    (2) to take fish by angling limited to seven consecutive days selected by the licensee,
1.12$26.50;
1.13    (3) to take fish by angling for a 72-hour period selected by the licensee, $22;
1.14    (4) to take fish by angling for a combined license for a family for one or both parents
1.15and dependent children under the age of 16, $50.50;
1.16    (5) to take fish by angling for a 24-hour period selected by the licensee, $8.50; and
1.17    (6) to take fish by angling for a combined license for a married couple, limited to 14
1.18consecutive days selected by one of the licensees, $38.50.; and
1.19(7) to take fish by spearing from a dark house, $37.50.
1.20    (b) A $2 surcharge shall be added to all nonresident fishing licenses, except licenses
1.21issued under paragraph (a), clause (5). An additional commission may not be assessed
1.22on this surcharge.

2.1    Sec. 2. Minnesota Statutes 2008, section 97C.371, is amended by adding a subdivision
2.2to read:
2.3    Subd. 5. Nonresidents. Nonresidents may spear from a fish house or dark house.

2.4    Sec. 3. RULES.
2.5The commissioner of natural resources shall amend Minnesota Rules, including part
2.66262.0600, to allow taking fish by spear by nonresidents in compliance with sections
2.71 and 2.
2.8EFFECTIVE DATE.This section is effective the day following final enactment.
