AN ACT to amend the education law, in relation to prohibiting on campus
residency as a requirement for scholarships, grants and awards offered
by the state university of New York
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
1 Section 1. The education law is amended by adding a new section 141 to
2 read as follows:
3 S 141. SCHOLARSHIPS, GRANTS AND AWARDS; CAMPUS RESIDENCY PROHIBITED.
4 1. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, NO SCHOLARSHIP, GRANT,
5 AWARD OR ANY OTHER FORM OF TUITION ASSISTANCE OFFERED BY ANY COLLEGE OF
6 THE UNIVERSITY, SHALL, AS A CONDITION OF ELIGIBILITY, REQUIRE THAT THE
7 STUDENT RECEIVING SUCH SCHOLARSHIP, GRANT, AWARD OR ASSISTANCE RESIDE ON
8 CAMPUS IN CAMPUS HOUSING, EXCEPT WHERE SUCH SCHOLARSHIP, GRANT, AWARD OR
9 ASSISTANCE IS SPECIFICALLY DESIGNATED FOR ON-CAMPUS HOUSING OR BOARD.
10 2. NOTHING IN THIS SECTION SHALL BE CONSTRUED TO PROHIBIT ANY COLLEGE
11 OF THE UNIVERSITY FROM REQUIRING THAT A STUDENT BE A RESIDENT OF THE
12 STATE OF NEW YORK IN ORDER TO BE ELIGIBLE TO RECEIVE A SCHOLARSHIP,
13 GRANT, AWARD OR ANY OTHER FORM OF TUITION ASSISTANCE.
14 S 2. This act shall take effect July 1, 2009.
