FISCAL ANALYSIS


ASSUMPTION


Officials from the Office of the Governor and the Office of the Secretary of State assume the proposal would have no fiscal impact on their agencies.


Officials from the Office of State Courts Administrator (CTS) assume for each circuit court judge, the costs are as follows:


            Circuit Court Judge:   $116,975 per year, plus fringe benefits

            Court Reporter:           $53,410 per year, plus fringe benefits


The total annual cost for these new positions would be $170,385 plus fringe benefits, and 2 FTE.


There is no appropriation in the judiciary’s budget to fund the new position. Should this legislation pass, CTS would have to request a supplemental appropriation for FY 08 in the amount of $146,085.


Oversight has adjusted the Office of State Courts Administrator’s (CTS) fiscal estimate to include equipment and expenses for the Circuit Court Judge and Court Reporter. Oversight has adjusted CTS’ fringe benefit estimates to reflect 76.44% for the Circuit Court Judge.


Oversight assumes Greene County may experience increased costs with an increase in the number of circuit court judges. Oversight has reflected this increase as Unknown.


Officials from the Missouri State Employees’ Retirement System and Greene County did not respond to Oversight’s request for fiscal impact.

FISCAL DESCRIPTION


The proposed legislation would add one additional circuit judge to the thirty-first judicial circuit, beginning January 1, 2009.


This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
