FISCAL ANALYSIS


ASSUMPTION


Officials from the Office of the Governor, Department of Public Safety – Missouri State Highway Patrol, and the Missouri Senate assume the proposal would have no fiscal impact on their agencies.


Officials from the Department of Public Safety – Director’s Office (DPS) assume they would incur costs for quarterly meetings, with seven of the nine commissioners having to travel to Jefferson City. DPS assumes seven commissioners would require one night’s lodging and 1.5 days of meals for each meeting. Mileage is based on an average of 300 miles round trip for each meeting. DPS assumes the total cost to be approximately $6,200 in FY 09 and $7,700 in subsequent years.


Officials from the Office of Prosecution Services, Office of the Secretary of State, Independence Police Department, Kansas City Police Crime Laboratory, St. Louis Metropolitan Crime Laboratory, and the St. Louis County Crime Laboratory did not respond to Oversight’s request for fiscal impact.

FISCAL IMPACT - Small Business


No direct fiscal impact to small businesses would be expected as a result of this proposal.



FISCAL DESCRIPTION


The proposal creates a “Crime Laboratory Review Commission” to independently review the operations of crime laboratories in the state of Missouri that receive state-administered funding.


The commission shall have the power to assess the capabilities and needs of the crime labs and make recommendations for improvements, authorize independent external investigations into allegations of misconduct or negligence, issue reprimands to crime labs and their employees or contractors found to be negligent or engaging in misconduct, make recommendations for crime lab procedure when labs are found to be negligent, and issue reports summarizing findings of negligence or misconduct and making recommendations regarding revocation or suspension of grant funding.


The commission shall submit an annual report to the Department of Public Safety and to the governor making recommendations to improve the operation of crime labs in the state of Missouri.


The Department of Public Safety shall have the authority to revoke grant money from a crime lab if it does not cooperate with the commission or if allegations of serious negligence or misconduct are substantiated by the commission.


This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
