FISCAL ANALYSIS


ASSUMPTION


Officials of the Office of State Courts Administrator stated there would be no fiscal impact on the Courts.


Officials of the Department of Public Safety - State Highway Patrol assume no fiscal impact.


Officials of the Department of Revenue assume no fiscal impact.


Officials of the Department of Transportation assume that this bill allows first class County Commissions to omit the procedural requirements in section 304.130.2 when the commission wants to adopt a regulation to amend the speed limit on county roads.


Officials stated that current section 304.130.2 requires the County Commission to seek and receive MHTC’s approval prior to regulating stop signs, signal lights or speed limits on state or federal highways. It is MoDOT’s position that this approval is still required on state or federal highways, as such approval would not considered a “procedural requirement” as in to providing notice, holding a hearing, etc. Officials assume no fiscal impact from this legislation.


Officials assume no fiscal impact to the General Revenue Fund, Road Fund, or Transportation Fund.


Oversight assumes that first class counties would be able to omit the procedural requirements when adopting a regulation amending a speed limit on county roads. Oversight assumes counties would realize savings from not having to hold three public hearings, publication costs, and some administrative savings from making signs and posting them. Oversight has no way of knowing how many counties of the first class would be adopting regulations amending speed limits on county roads, or the amount of savings realized.


Oversight will show an unknown savings to first class counties. Savings would be expected to be less than $100,000 annually on a statewide basis.

FISCAL IMPACT - Small Business


No direct fiscal impact to small businesses would be expected as a result of this proposal.


FISCAL DESCRIPTION


This bill exempts first classification counties from the procedural requirements when establishing regulations related solely to speed limits. The speed limits in these counties will take effect immediately upon approval of the County Commission.


This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
